It seems that soon, being unfaithful in Mexico may no longer be taken “lightly.” Those who cheat might not only risk losing their partner’s forgiveness—but also everything they own.
A new law proposal in Mexico City aims to establish that if one spouse is unfaithful, they could lose all rights to shared assets in the event of a divorce, meaning the betrayed partner could keep 100% of the property.
The initiative seeks to amend the local Civil Code to give judges the authority to order that the unfaithful spouse forfeit their share of the marital assets.
The proposal also covers serious offenses such as domestic violence, infidelity, unjustified abandonment, and untreated addictions.
Currently, infidelity does not usually affect the division of assets in divorce cases. However, if this initiative passes, it could dramatically change how marital property is handled when infidelity is proven.
